Welcome to Avieva Jewels (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website and the sale of our jewellery products (“Products”) via our online store, and shipments to you anywhere in the world. By accessing or using our website, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms.
1. Eligibility & Account
1.1 You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to place an order with us.
1.2 If you create an account with us, you agree to provide accurate, current, and complete information about yourself, and to keep it updated. You are responsible for all activities that occur under your account.
2. Product Information, Availability & Accuracy
2.1 We endeavour to display accurate descriptions, images and specifications of our Products, including those made of lab grown diamonds and gold. However, colour, texture, finish and other details may vary slightly from online images.
2.2 All orders are subject to availability and confirmation of the order price at the time of dispatch. Prices shown online may change without notice until an order is accepted by us.
2.3 We reserve the right to limit the quantities of any Products, to refuse any order, or to cancel or change an order for any reason including (but not limited to) if Product is unavailable, mis–priced, or there is an error in the description.
3. Order & Contractual Process
3.1 When you place an order, you make an offer to purchase the Products listed in your order. A legally binding contract between you and Avieva Jewels will only be formed when we send you an order acceptance email (which may coincide with dispatching your Products).
3.2 Until our acceptance, payment may be authorised but not charged; after acceptance we will charge the payment method you provided.
3.3 If we cannot accept your order (for example due to unavailability, error in pricing or description, or shipping restrictions), we will inform you and will not charge you for the relevant Products.
3.4 For bespoke or personalised items (custom size, engraving, styling etc.), additional terms may apply (e.g., no standard right of cancellation) — please see any bespoke product description and our Returns & Refunds Policy for details.
4. Prices, Payment & Taxes
4.1 All prices are shown in GBP (£) unless otherwise stated and are inclusive of applicable UK-VAT for UK customers. For international orders, customs duties, import taxes or additional charges may apply in your destination country — you are responsible for these.
4.2 We accept payment via the methods displayed at checkout. Payment must be made in full at or before dispatch.
4.3 If you pay by credit or debit card (or other online method), you warrant that you are the cardholder or have been authorised by the cardholder to use the payment method.
5. Shipping, Delivery & Risk
5.1 We ship worldwide. Delivery times and cost will be as stated at checkout and confirmed in the dispatch email.
5.2 Title and risk in the Products pass to you when we (or our courier) deliver the Products to the address you have specified.
5.3 You are responsible for ensuring the delivery address is correct and that any import, customs or tax obligations in your jurisdiction are fulfilled.
5.4 If we are unable to deliver because you have provided incorrect shipping information or if you fail to collect your Products, we may cancel your order and you may be responsible for any additional costs incurred.
6. Returns, Refunds & Cancellations
6.1 For UK and EEA consumers, you have a statutory right to cancel or return Products within certain timeframes, except for bespoke/customised items where those rights may be limited. You should review our dedicated Returns & Refunds Policy for full details.
6.2 If you cancel under statutory rights, you must return the Products in the same condition as received, and you may be liable for direct costs of return.
6.3 If a Product is faulty or not as described, you must contact us promptly, and we will offer repair, replacement or refund in line with consumer law and our policy.
7. Intellectual Property
You may view and print pages for personal non-commercial use only; you may not reproduce, distribute, adapt or exploit any of the content without our express written permission.
8. Limitation of Liability & Disclaimers
8.1 To the fullest extent permitted by applicable law, we exclude all liability for indirect, consequential or special losses (including lost profits, loss of data, or business interruption) arising out of or in connection with your order or use of our Products or website.
8.2 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
8.3 We do not warrant that our website, its servers, or email communications are free from viruses or other harmful components. You use them at your own risk.
9. Force Majeure & Events Outside Our Control
We shall not be liable for any failure to perform our obligations when the failure is due to circumstances beyond our reasonable control (for example, strikes, lock-outs, extreme weather, supply chain disruptions, customs delays).
10. Governing Law & Dispute Resolution
10.1 These Terms and any contract under them are governed by the laws of England and Wales.
10.2 For UK/EEA consumers, nothing in these Terms affects your statutory rights.
10.3 Any dispute relating to these Terms or your order up to the value of the relevant jurisdictional threshold may be referred to the UK Alternative Dispute Resolution (ADR) body and/or the EU Online Dispute Resolution platform (as applicable).
11. Changes to These Terms
We reserve the right to change these Terms at any time. The version in force at the time you place an order shall apply to that order. Please check this page regularly.
